These terms and conditions (“Terms”) govern our luggage storage services (“Storage services”) at Fashion Arena Prague Outlet, Information Centre (the “Centre”). Please read these Terms carefully before using the Storage services. By using the Storage services, you accept these Terms and signify your agreement to be bound by these Terms.
The Storage services at the Centre is operated and provided to you by Via FAOC s.r.o. (Business Identification Number 02214041) with its registered office at Zamenhofova 440, Štěrboholy, 108 00 Praha 10, Czech Republic, registered with the Municipal Court in Prague under C 216782. References in these Terms to “we” or “us” are to this entity.
The purpose of the Storage services is storage of tourist luggage and baggage (“Stored Items”), only.
Information Centre which provides the Storage services accepts only standard luggage, baggage and other items which cannot injure, contaminate or cause damage to persons, equipment or other Stored Items. Following items are expressly excluded from Storage services and cannot be accepted by us for Storage services:
We do not inspect the content of the Stored Items. You are responsible for ensuring that the Stored Items handed over to us to be stored in the Storage services are meeting the Terms hereof, specifically that they do not contain any of the excluded items. You are fully liable for any damages caused due to breach of your obligation under these Terms.
The Storage services is being operated during the Centre operating hours only. In case that the Storage services is filled to its capacity, we are entitled to refuse storage of any other items.
While handing over your Stored Items to us, you are requested to fill in selected personal data on the luggage storage form, i.e. your name, ID document, mobile phone number, e-mail address. While collecting your Stored Items from the Storage Room, you will be required to present your identification document in order to evidence your identity and present your Storage services ticket received from us.
You are obliged to collect your Stored Items on the same day and are obliged to present yourself at the Information Centre in a timely manner, well in advance of the Centre closing times, i.e. at 7:45 p.m. at the latest. You are required to check the Stored Items upon collecting immediately and inform us about the potential ascertained damage; later complaints will not be taken into account.
Should you fail to timely collect your Stored Items, we will proceed in line with the applicable legal regulation and consider your Stored Items as lost items.
All lost items are deposited in the Fashion Arena Prague Outlet for 3 calendar days from their acceptance in a lockable room. If the owner of the lost item who makes himself or herself known by phone or e-mail by the end of the deposition period and requests extension of the deposition period in the Fashion Arena Prague Outlet, the deposition period shall be extended on the basis of such request by 10 calendar days at the maximum. If the lost item is not retrieved within the given period, the finding is reported and the lost item is handed over to the Lost Property Office managed by the City Hall of the Capital of Prague, the Trades Licensing and Civil Law Department.
For the due operation of the Storage services, the Centre collects and processes your personal data, as a data controller, exclusively for the purpose of providing the Storage services to you. The personal data will only be stored during the provision of the service (with the exception as mentioned above in the clause Uncollected items. For further information about the processing of your personal data, please read our Data Protection Policy, available at the Information Centre or accessible at www.fashion-arena.cz.
In light of the applicable legislation, you may request, at any time, access to your personal data, as well as the rectification, erasure or restriction of processing, via written request addressed to the Centre, sent to firstname.lastname@example.org or to Fashion Arena Prague Outlet, Zamenhofova 440, 108 00 Prague – Štěrboholy. Without prejudice to any other means of administrative or judicial redress, you have the right to lodge a complaint with the Czech Data Protection Authority or with another competent supervisory authority, pursuant to the applicable law.
Should you ascertain any damage to your Stored Items at the moment of their pick up, you must immediately report this to the Information Centre Officer and fill in a claims form.
We will not have access to information regarding the value of your luggage and will therefore a limit of our liability for loss or direct damage of your luggage to the amount of EUR 1,000 per item and a maximum of EUR 2,500 in total. We will only be responsible for loss or damage to your luggage where such loss or damage is directly attributable to our actions and/or omissions. Your statutory rights are not affected.
Should we ascertain that your Stored Items have caused damage to other Stored Items, property or our employees, you and we will record the incident in a report before the Stored Items are handed over back to you. Based on the report, you are obliged to pay the damages caused by your Stored Items. If you refuse to record the incident, we are entitled to refuse to hand over the Stored Items to you.
The Terms are governed by Czech law, and are subject to the exclusive jurisdiction of the courts of the Czech Republic. We hereby inform you that the competent authority for Alternative Dispute Resolution of consumer disputes related to Storage services is Česká obchodní inspekce, seated at Štěpánská 567/15, 120 00 Praha 2, Czech Republic. You may seek additional information from internet sites of Česká obchodní inspekce at www.coi.cz.
